Morning NewsElian Gonzalez Case: Custody Dispute Briefly Shifts to Federal Court in MiamiAired February 22, 2000 - 9:21 a.m. ETTHIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED. DARYN KAGAN, CNN ANCHOR: And now to Florida, the custody dispute over 6-year-old Elian Gonzalez shifts to a federal court in Miami this morning, but only briefly. CNN's Susan Candiotti joins us now. She is in Miami with the details. Susan, good morning. SUSAN CANDIOTTI, CNN CORRESPONDENT: Hello, Daryn. Only briefly because the very well liked and well respected judge in this case, William Hoeveler suffered a mild stroke over the weekend. And so today, the chief judge is going to be calling all the parties together to announce the name of a new judge who will take over this case. The court is then expected to reschedule key arguments that were supposed to take place today. Attorneys will be debating whether a U.S. court has jurisdiction in this case. Legal experts believe that the INS was and is within its right to rule that 6-year-old Elian Gonzalez should be reunited with his father. The boy's lawyers argue that the youngster has been denied his right to be heard in court, and deserves a political asylum hearing. Now meantime, in another development, Elian's attorneys are jumping up and down about a possible link between their case and a Cuban spy scandal. The boy's attorneys charge that a Cuban diplomat who met with Elian's grandmothers in Florida last month may have been in cahoots with a U.S. immigration supervisor from Miami, who was arrested last Friday on spy charges. However, U.S. authorities deny that there is any link at all between that INS supervisor, who was arrested last week, and the Elian Gonzalez case or the spy scandal. Susan Candiotti, CNN, reporting live in Miami.
