DARYN KAGAN, CNN ANCHOR: Today's "CNN 20": scandal hits the Kennedy clan.

BERNARD SHAW, CNN ANCHOR: William Kennedy Smith was formally charged today in the alleged rape of a woman at the Kennedy family estate in Palm Beach, Florida. Smith, the nephew of Massachusetts Senator Edward Kennedy.

WILLIAM KENNEDY SMITH: I didn't commit an offense of any kind, and I am confident that is going to come out.

GRETA VAN SUSTEREN, CNN LEGAL ANALYST: William Kennedy Smith met a woman in a bar, and they went back to his family's estate in Florida and something happened. We really don't know for sure. The complainant said she was raped. William Kennedy Smith said that it was consensual, that it was not rape.

It went to trial and the jury was not convinced beyond a reasonable doubt that it was rape.

UNIDENTIFIED FEMALE: He had me on the ground, and I was trying to get out from underneath of him because he was crushing me.

VAN SUSTEREN: What I think what happened with her is that in a rape case it is largely credibility, it is a he says/she says. What the jury had the advantage of that we, the viewers, didn't, is they got to see her. They got to look her in the eye. We were shielded by that dot, and they made a credibility determination.
