Election 2000: Judge Issues Injunction on Certifying Election Results in Palm Beach County, Will Hear Arguments Tuesday

Aired November 10, 2000 - 10:05 a.m. ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

BILL HEMMER, CNN ANCHOR: Every vote does count. They know that in Palm Beach county. Here's CNN's John Zarrella to pick things up live with us this morning from there.

John, hello again.

JOHN ZARRELLA, CNN CORRESPONDENT: Hello, again, Bill. And they're going to continue to let everyone know about it here. We understand now that there are two more rallies planned, one on Sunday, down in Boca Raton, Florida. which is part of Palm Beach county, and another one scheduled now for Monday back here at the government center.

It's very quiet here today because it's Veterans Day, a holiday here for state workers. Not much business, if any, going to be conducted on state level today. But a circuit court judge here in Palm Beach county did conduct some significant business last night at about 8:30 p.m. Kathleen Kroll, Judge Kathleen Kroll, issued an injunction which basically prohibits Palm Beach county from certifying the election results.

Now, the judge she that will hear the arguments on Tuesday -- in court on Tuesday morning, we understand -- and it was brought by two women from Boca Raton who say that the election was just unfair. And that, of course, goes back to the butterfly ballot issue that we have heard so much about. That folks thought were voting for Al Gore, but in fact, were not voting for Al Gore, but for Pat Buchanan.

Now, yesterday afternoon, at about 5:00 in the afternoon, here in West Palm Beach, the supervisor of elections office and the elections board, certification board, folks came out and said they would go ahead and do what both the Democratic and Republican parties had asked. They will conduct a recount of the recount.

The Republican party has asked for a full machinery count. That will begin, we are told, 9:00 a.m. tomorrow morning. The Democratic Party asked for manual count, a hand count.

They will recount one percent of the vote, about 4,600 votes from, we believe, three precincts. And that will also be conducted beginning at 9:00 a.m. tomorrow morning. All of that should take most or the better part of tomorrow. We are told not to expect any results from those two counts until sometime after dark here tomorrow night. So continuation of the legal maneuvering, and probably going to be stepped up further next week with at least the one court challenge, and we understand, there are, perhaps, five or six other court challenges that could end up getting aired sometime next week here in Palm Beach county -- Bill.

HEMMER: All right, John Zarrella, live in West Palm. John, thank you.
