Election 2000: Bush Lawyers Ask for Postponement at 11th Circuit Court of Appeals

BILL HEMMER, CNN ANCHOR: Back outside circuit court, second floor again, as we are waiting here in Tallahassee for the next lawsuit to be filed. Again, the Gore campaign is expected to file its suit against three different counties here in Florida, which will continue the contest period, which we expect to get under way at any moment. The three counties, again, involved are Nassau, Miami-Dade, and Palm Beach.

Now let's move from Leon County up to circuit court in Atlanta. If you continue to follow the legal bouncing ball here. The 11th Circuit Court of Appeals is about to hear a Bush motion here. This is an argument on two fronts from the Bush campaign that is trying to rule, or get ruled anyway, that those manual recounts are unconstitutional.

Watching that, here is CNN's Martin Savidge this morning.

Marty, good morning to you.

MARTIN SAVIDGE, CNN CORRESPONDENT: Good morning to you, Bill.

It is a legal super bowl, you could call it here. It is really a lot of bounce to it. There has been some action here at the 11th Circuit Court of Appeals this morning. But in order to understand what is happening today, you have to understand what was going on in Florida 10 days ago, when the Republicans first came to this court. That was the time when the manual recounts in the state of Florida were just beginning and the Republicans were very concerned that those manual recounts might overturn the election in favor of Vice President Al Gore.

They came to this court, at that time, seeking a temporary -- emergency, temporary restraining order, trying to have the manual recounts stopped. They were not successful in that. But, the court said, you could continue to argue your reason as to why you do not want the counts in the manual recounts to be tabulated in the overall final statistics.

That was part of the process today. It was to the continuation, more filings to be held.

The Republicans have now said, hey, a lot has happened since we came to you 10 days ago, the certification that took place last night, the manual recounts that shows George Bush still in the lead, and the fact that now the U.S. Supreme Court has decided to weigh into this matter. The Republicans this morning have basically filed and said, if this court was considering further legal matters, such as oral arguments on the case, the Republicans are asking that they hold off and wait until next week. They say that, with the Supreme Court filing, their attorneys are simply too busy, they are focusing now on the U.S. Supreme Court, and they ask that the activity here be delayed.

The Democrats reportedly are in cooperation with the Republicans on that matter. They, too, are willing to say and ask the court to delay things until next week. And that is where things stand.

However, it remains to be seen, if the court here will go along with that and say, all right, we will hold off on any decisions.

We are expecting to have some sort of announcement from the 11th Circuit Court of Appeals by 3:00 this afternoon.

In other words, the Republicans say, we need more time, but we would like to hold our seat here in this courtroom just in case we need to come back at a later date. I hope that's clear, Bill.
