Officer gets new trial in Detroit beating caseJuly 31, 1997Web posted at: 8:02 p.m. EDT (0002 GMT) LANSING, Michigan (CNN) -- The Michigan Supreme Court has overturned the second-degree murder conviction of one of two white Detroit police officers charged in the beating death of African-American motorist Malice Green in 1992. The court upheld the conviction of the second officer. In a 5-to-1 ruling, the court held that outside influences, including the showing of the film "Malcolm X," tainted the juries that convicted Walter Budzyn and Larry Nevers. As a result, the justices said Budzyn should get a new trial. They said Nevers received a fair trial because evidence of his guilt was stronger. The Associated Press contributed to this report.
